Product Testing Conditions
Effective from 01.01.2025
These conditions govern your use of the product testing campaigns (hereinafter referred to as "Conditions") processed by: SwissBioLab EU - Distribution, 4, Rue Alfred Bastin, 74100 Annemasse, France.
We want to ensure that you understand the conditions under which you test and evaluate our products.
By registering online, you can participate in product testing campaigns to become a product tester for the Alpx brand.
The product testing campaigns allow you to give us your opinion and feedback on our products, so that we know what you want and what you are looking for. You are free not to participate.
By participating in our product testing campaigns, you accept these Conditions.
ARTICLE 1 - GENERAL CONDITIONS OF PARTICIPATION IN PRODUCT TESTING CAMPAIGNS
1.1 Conditions of participation
Participation in one or more product testing campaigns is completely free of charge and with no obligation to purchase.
Participation in the product testing campaigns is limited to persons with full legal capacity (i.e., over 18 years of age at the start of the campaign and who are not legally incapacitated or under general guardianship) and who are domiciled in Switzerland.
For each campaign, only one participation per email address and per person is permitted.
1.2 Product testing campaign process
To participate in a product testing campaign and become a product tester, please follow the procedure below:
1) Fill in the registration form, enter your first name and your email address
2) Read and accept these Conditions
3) Click on "Participate"
You will then receive an email to confirm your registration.
1.3 Participating in a product testing campaign
After your registration, you can participate in a product testing campaign.
It is up to you to decide if a product testing campaign interests you. You will be asked to:
• Provide and/or verify your postal address. This address must be correct and accurate and be located in Switzerland.
• Answer specific questions about your habits and your care needs. You agree to answer these questions correctly and honestly. Your answers will help us decide whether or not you are eligible to participate in a product testing campaign.
Participation in a product testing campaign will never be remunerated.
1.4 Feedback
After testing the product, please provide us with your honest opinion (hereinafter referred to as "Feedback").
ARTICLE 2 - OBLIGATIONS OF THE PRODUCT TESTER
2.1 General obligations
By participating in a product testing campaign, you declare that you are acting in your own name and that all information concerning you is correct and accurate.
Upon receipt of the product, you agree to carefully follow the corresponding instructions.
You agree to provide the most fair and complete feedback possible on the tested product.
The product testing campaign is limited in time. You must therefore provide your comments in a timely manner. We will inform you of the time available to provide comments on the product.
The purpose is to test the product personally and not to entrust it to others for feedback or a response on your behalf.
2.2 Feedback requirements
By participating in our product testing campaign, you agree to share your comments on the tested product.
By publishing comments, you declare that:
- you are the author of the feedback, you are not impersonating another person, you will not use a false email address and you are in no way misleading as to the origin of your feedback;
- your feedback originates from you and does not infringe upon the intellectual property rights of third parties;
- all content that you publish is true and correct.
You also declare that you will not publish content:
- that is not related to the evaluation of the products you have tested;
- for which you receive compensation of any kind, financial or otherwise, from third parties or which may be considered as advertising or promotion (including content that causes commercial harm to Alpx);
- that contains references to other websites, URL addresses, email addresses, contact information or telephone numbers;
- with computer viruses or instructions for the creation of computer viruses or other potentially harmful computer programs or files.
ARTICLE 3 - TERMINATION/EXCLUSION
We reserve the right to exclude you from other product testing or sample campaigns if:
- you do not provide honest and open comments on the tested product;
- you have provided inaccurate personal information such as your email address (by creating multiple email addresses leading to you) with the intention of receiving multiple test products or samples;
- you violate these Conditions.
ARTICLE 4 - INTELLECTUAL PROPERTY RIGHTS AND IMAGE RIGHTS
4.1 Intellectual property
If your comments and/or photos give rise to protection by intellectual property rights, in particular literary and artistic rights, you, as a product tester, explicitly and free of charge authorise us to: reproduce, represent, modify, adapt (including translate) your photo(s) within the framework of the product testing campaign, transfer and distribute for all internal or external communication purposes, as well as for all public and PR purposes and for promotion and advertising via the following media:
(i) Internet
(ii) Press
(iii) Social networks
(iv) Point of sale (POS)
(v) Outdoor advertising (billboards)
(vi) Audio/Audiovisual
(vii) Applications, digital services
(viii) E-commerce platforms hereinafter referred to as "Media".
This authorisation also allows SwissBioLab EU - Distribution to modify the original photos and to add or remove parts provided that these do not substantially alter them. This authorisation is granted free of charge from the first use of your photo(s) via the website worldwide without any limitation in number or extract, via the Media, for the entire duration of the intellectual property right, in particular literary and/or artistic.
You hereby expressly declare that you own all rights to the comments and photos.
4.2 Image rights
By publishing your comments and photos, you, as a product tester, expressly authorise us to: reproduce, represent, modify, adapt, transfer and distribute your image within the framework of the product testing campaign for all internal or external communication purposes, as well as for all public and private purposes and for promotion and advertising via the media referred to in Article 4.1. This authorisation is granted free of charge from the first use of the product tester's image without any limitation in number or extract, via the media, for a period of 3 years.
It is understood that communication material containing the product tester's image may be difficult to remove from social media channels and websites (such as Facebook, Instagram, Youtube, etc.). This communication material may remain on the social media channels and websites where it was initially displayed, provided that after the aforementioned 3 years SwissBioLab EU - Distribution does not publish or allow others to publish this material again. The term "image" refers to all the attributes of the product tester's personality, including, but not limited to, their photo, voice, first and last name, signature, social media activity, skills through their professional activities and their professional title(s).
ARTICLE 5 - PERSONAL DATA
We may collect personal data about you, in particular when:
(i) you register;
(ii) you wish to participate in a product testing campaign;
(iii) you send us an email;
(iv) you give your opinion on our products.
